The case involved an unidentified motorist causing an accident between plaintiff and our client. As a result of the uninsured motorist’s negligence, plaintiff slammed on his brakes to avoid the uninsured motorist. Unfortunately, our client was unable to stop while driving his semi and rear-ended plaintiff. Plaintiff claimed a significant brain injury and a permanent lost earning capacity and was seeking in excess of $500,000 in damages. A pretrial agreement was reached on a high/low in respect to damages and the jury returned a verdict less than the low agreed upon, resulting in a favorable verdict.
