Micaela Brinsley and Amy Doyle won summary judgment in La Crosse County in an inverse condemnation case. A commercial building owner alleged that a city was negligent in the construction and design of an intersection, which allegedly caused vehicles to collide with the building. The plaintiff also alleged that the city’s actions created a nuisance and constituted a taking of Plaintiffs’ property as the basis for constitutional and statutory inverse condemnation claims. After discovery, briefing and oral argument, the trial court held that the Plaintiffs’ claims were barred by governmental immunity and because the claims were not supported by sufficient evidence.
