On January 19th, 2021, Marcella Spoto won a Motion to Dismiss in the Eastern District of Wisconsin in a Fair Debt Collection Practices Act (FDCPA) case for a Class Action related to alleged debt collection violations. We represented the defendant, who was acting as a debt collector, and argued in briefing and at the hearing that the debt collection acts met the requirements of the FDCPA and that the Plaintiff had not suffered an injury to satisfy standing under the U.S. Constitution. The Court agreed that there was no standing and dismissed the case in full.
